This Privacy Policy explains how WinVero (“WinVero,” “we,” or “us”) collects, uses, and discloses information about you when you use our website, applications, and related services (collectively, the “Services”) or otherwise interact with us. This Policy also serves as our Notice at Collection for California residents.
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by revising the date at the top of this page and, where appropriate, by providing additional notice. Your acceptance of this Policy and the version you accepted are recorded in your account.
1. Information We Collect
Information you provide. When you join our waitlist, create an account, use the chat, upload documents, or communicate with us, you may provide your name, contact details, date of birth, and information about your accident and claim, including accident details, injuries, medical treatment and records, bills, insurance and policy information, employment and wage information, and settlement communications. Your claim information necessarily includes information about other people involved in your accident, such as the other driver, witnesses, insurance adjusters, and healthcare providers.
Identity verification. Before we take any action toward an insurer on your behalf, we verify your identity through a third-party verification provider. That provider captures your government-issued ID and a photograph of you under its own privacy policy; WinVero receives only the result of the verification.
Information from other sources. With your authorization, we receive information from insurers, healthcare providers, records custodians, and public records sources such as police departments. If you sign in with a third-party account such as Google, we receive basic profile information from that service.
Information collected automatically. When you use the Services we collect device and usage information, such as IP address, browser and device type, pages viewed, and actions taken, using cookies and similar technologies. We derive approximate location from your IP address. We do not collect precise device location.
Information we do not collect. When we process documents you upload, we do not extract or store Social Security numbers, driver license numbers, license plate numbers, medical record numbers, patient account numbers, insurance member identification numbers, or the contact details or dates of birth of third parties other than witnesses. Information we do not collect cannot be disclosed or breached.
Sensitive personal information. The Services involve health and medical information, government identification (held by our verification provider), account credentials, and financial information that may appear in documents you upload. We use sensitive personal information only to provide the Services you request, for security and fraud prevention, and as otherwise permitted by law.
2. How We Use Information
We use the information we collect to:
- Provide, maintain, secure, and improve the Services;
- Build and organize your claim file from the records and documents you provide;
- Generate a settlement estimate and draft claim-related documents and correspondence for your review;
- Send communications you approve to insurers and other parties, and receive and organize their responses;
- Provide notifications, reminders, and support related to your claim;
- Connect you with a lawyer or medical provider when you request it;
- Communicate with you about WinVero products, features, and educational content, which you may opt out of at any time;
- Detect, investigate, and prevent fraud, security incidents, and misuse;
- Comply with legal obligations and establish, exercise, or defend legal claims.
Artificial intelligence. The Services use artificial-intelligence technology, including models operated by third-party providers. Information about your claim is stripped of your name and other identifying details before it is sent to those providers. Documents that cannot be redacted without becoming unreadable, such as medical bills and records, are sent only to a single provider under a written agreement that prohibits it from retaining that information or using it to train its models. WinVero’s AI produces estimates, drafts, and summaries for your review; it does not make decisions about your claim, and it does not make automated decisions that have legal or similarly significant effects on you.
Improving the Services. We use information derived from your use of the Services, including your conversations, claim facts, and claim outcomes, to improve, calibrate, and train the Services, after removing your name and other identifying information. We maintain and use this information in de-identified form, will not attempt to re-identify it, and contractually prohibit any recipient from doing so. We do not use information identifying other people involved in your accident — including the other driver, witnesses, or anyone named in a police report — for this purpose. We will not use your name or other identifying information in any testimonial or case study without your separate written consent.
3. How We Disclose Information
We disclose personal information in the following circumstances:
- At your direction, to insurers, healthcare providers, records custodians, government agencies, and other parties involved in your claim. Communications and documents prepared through the Services are sent only after you review and approve them.
- With law firms and medical providers you choose. If you request an attorney review, we share your claim information with an affiliated or participating law firm for its evaluation; your identity is shared when you choose to connect. If you ask us to help you find treatment, we share your contact and injury information with the provider you select.
- With service providers that process information on our behalf, such as cloud hosting, identity verification, artificial-intelligence processing, communications delivery, and analytics providers, under contracts that limit their use of your information to providing services to us.
- With our affiliates, including affiliated licensed California law firms, to the extent necessary to provide the Services and for compliance oversight.
- As required by law, including in response to legal process or lawful requests by public authorities, or where we believe disclosure is necessary to protect the rights, property, or safety of WinVero, our users, or others.
- In a business transaction, such as a merger, acquisition, financing, or sale of assets.
- With your consent.
We also use and disclose aggregated or de-identified information that cannot reasonably be used to identify you.
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising. We treat Global Privacy Control signals as valid opt-out requests. We do not knowingly sell or share the personal information of anyone under 16.
Financial disclosure. WinVero is owned by a licensed California law firm. If you choose to be represented by that firm or by another firm through the Services, that firm’s fee is governed by a separate written agreement between you and the firm and is paid from your settlement. WinVero itself charges you nothing, receives no part of your settlement, and does not sell your personal information.
4. Email and Text Messages
We send claim-related and account communications by email and in the portal. Text messages beyond the code used to verify your mobile number are sent only with your separate consent; consent is not a condition of using the Services; message and data rates may apply; reply STOP to cancel and HELP for help. We do not share, sell, rent, or disclose mobile phone numbers or text-message opt-in information to third parties or affiliates for marketing or promotional purposes. You may opt out of promotional email and text messages at any time by following the instructions in the message or by emailing legal@winvero.com.
5. Cookies and Analytics
We and our service providers use cookies and similar technologies to operate the Services, remember your preferences, and understand how the Services are used. We do not allow third parties to collect information about your use of the Services for their own advertising purposes. Most browsers allow you to reject or remove cookies; doing so may affect the availability of some features.
6. Data Retention
We retain personal information for as long as needed to provide the Services, to comply with legal, regulatory, and contractual obligations, to resolve disputes, and to enforce our agreements.
We retain the personal information associated with your account and your claim — including chat conversations, documents you upload, communications with insurers, estimates, drafts, consents and approvals, identity-verification results, and settlement records — for five years after your claim closes or your account is closed, whichever is later. This period reflects applicable California limitations periods and professional record-retention standards.
Information subject to a dispute, legal hold, or ongoing regulatory matter is retained until that matter is resolved, regardless of the period above. Backups are retired on the same schedule as the records they contain.
De-identified information used to improve the Services contains nothing that identifies you and is retained indefinitely. We maintain that information in de-identified form and do not attempt to re-identify it.
You may request a copy of the personal information we hold about you at any time, as described in Your California Privacy Rights below.
7. Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and at rest, access controls, and monitoring. No system is completely secure, and we cannot guarantee the security of information transmitted over the Internet. You are responsible for keeping your account credentials secure. If a breach affecting your personal information occurs, we will notify you as required by applicable law.
8. Your California Privacy Rights
If you are a California resident, you have the right to request that we (a) disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes, and the categories of third parties to whom we have disclosed it; (b) correct inaccurate personal information; (c) delete personal information we collected from you, subject to legal exceptions; and (d) provide your personal information in a portable format. Because we do not sell or share personal information and use sensitive personal information only for permitted purposes, no opt-out or limitation request is needed. We will not discriminate against you for exercising your rights.
To exercise these rights, email legal@winvero.com. We will verify your request, which for account holders means confirming your identity through the email address associated with your account plus a secondary confirmation, and respond within 45 days, extendable once by 45 days with notice. You may use an authorized agent, in which case we will require proof of the agent’s authority and verify your identity. If we deny a request, we will tell you why and identify the exception we relied on.
These rights also belong to California residents who are not WinVero users but whose information appears in a claim file. Requests to delete information that is part of an active or recently resolved claim may be subject to exceptions for completing a transaction, complying with law, or exercising or defending legal claims.
California Civil Code § 1798.83 permits California residents to request information about disclosures of personal information to third parties for their direct-marketing purposes; we make no such disclosures.
9. Medical Information
WinVero is not a healthcare provider or health plan. You decide which medical records, if any, to share with us. We treat medical information as sensitive, use it only to organize, value, and present your claim as you direct, and disclose it only to recipients you approve.
10. Information About Other People
A claim is made against someone, so your claim file necessarily contains information about other people — most often the other driver, and sometimes witnesses, adjusters, or others named in a police report. Those people are not WinVero users and have not agreed to anything with us.
We use that information only to pursue your claim. We do not use it to improve or train the Services, and we do not disclose it except as part of your claim or as required by law. Where a document or communication prepared through the Services refers to another person, their information is added within our own systems rather than being sent to our artificial-intelligence providers. If you are a California resident whose information appears in a WinVero claim file, you may contact legal@winvero.com to exercise the rights described above.
11. Children
The Services are for adults 18 and older, and we do not accept claims by or on behalf of minors. We do not knowingly collect personal information from anyone under 18; if we learn that we have, we will delete it. Contact legal@winvero.com if you believe a minor has provided information to us.
12. Where Information Is Processed
The Services are offered only to residents of California and are operated from the United States. Your information is processed and stored in the United States.
